HATHA EQUUS CLINICS CANCELLATION POLICY and LIABILITY WAIVER


CANCELLATION POLICY

Cancellation is allowed until 2 weeks prior. Refunds are until then available minus a processing fee and 25% for admin costs.

Past the 2 week mark, refunds are not available.

You can, however, choose to find someone to replace you.

Do check in with us and the host: if either of us has a waitlist, we'll be glad to help. We cannot guarantee it, however.

If we don't have a waitlist, it will be up to you to find your replacement and let them reimburse you directly - unless you've chosen to donate your ticket to them of course.

You can also choose to reallocate the entire fee to our online services - please check in with us, in case, and we'll direct you to finding the right fit for you.

UNFORESEEABLE EVENTS

- If you were planning on attending with your horse (where applicable) and they get injured last minute, we will try to help as much as we can so that you don't lose your ticket. Just communicate with us and the host with as much advance as you can, so that we can try to find you a good alternative horse partner .

- If we need to cancel last minute for any reason (illness, emergency, extreme weather), the clinic will be rescheduled.

- Extreme weather: we are "rain or shine" people, and we believe that there is no good or bad weather, just appropriate (or not) equipment. If the weather is extreme enough to make it dangerous for most participants to get to the venue, the clinic will be rescheduled.

POST-CLINIC REFUNDS

There are no post-clinic refunds available.

LIABILITY RELEASE FORM

HATHA EQUUS LLC Waiver and Release of LiabilityWARNING - Under Colorado Law, an equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities, pursuant to section 13-21-119, Colorado Revised Statutes.

Please carefully read each paragraph.

GENERAL RELEASE

•I am fully aware and fully understand that all horses are unpredictable and dangerous.

•I realize that placing my children, or myself in the environment of an equestrian facility or equine training/learning environment is a potentially hazardous situation.

•I understand that riding horses or ponies is a dangerous sport. I am aware that bodily injury is an inherent risk of working around or riding horses.

•I understand that death of people from equestrian accidents is possible.

•I realize that professional instruction cannot prevent serious injury or death from activities including, but not limited to working around, lunging, feeding, handling, or riding horses and ponies.

•I understand that lunging or jumping horses or ponies are particularly dangerous activities and that serious injury or death of riders or horses is possible.

•I am aware that serious injury or death of my horse is possible when it is handled, trained, or in a lesson.

•I understand that I am fully responsible for any guests that I may bring to attend or observe a lesson or instruction by Elizabeth D. Riecks or Giorgia Ghizzoni.

•I understand that I am fully responsible for fully informing the guest of all risks related to the handling or riding of horses. 

•I understand that I am fully responsible for informing guests about horse's temperament, training, habits, and for determining that the guest is sufficiently experienced to ride the horse.

HELMET RELEASE

•I acknowledge that helmets may offer added protection from head injuries and that mounting, sitting on, or riding a horse without a helmet dramatically increases my risk of serious head injury in the instance of a horse-related accident.  

•Should I choose not to wear a helmet while mounting, sitting on or riding a horse, I assume all risk of head injury, and hereby release and hold-harmless Elizabeth D. Riecks, HATHA EQUUS LLC, and its volunteers, employees, and associates from any liability for bodily damage to myself as a direct result of not wearing a helmet.

•I acknowledge any child under 18 years of age is required to wear a helmet at all times while mounting, sitting on, or riding a horse.

MEDICAL RELEASE

•Elizabeth D. Riecks, her volunteers, employees, and associates, have my permission to initiate emergency first aid treatment for my children, my animals, and myself in case of an accident. 

•In the case my emergency contact and I are unreachable, Elizabeth D. Riecks, her volunteers, employees, and her associates have my permission to authorize emergency medical treatment by qualified medical personnel for my children or myself, and veterinary treatment by qualified veterinary personnel for my animals.

MEDIA RELEASE

*Hatha Equus will make a concerted effort to get permission from clients to be the main feature of a photo or video they might use in their promotional or educational material.

•However, I understand that photos and videos may be taken for promotional/educational materials for Hatha Equus in which I may inadvertently appear in the background or sidelines of a screen or shot. I will not hold Hatha Equus liable for any accidental captures of me, my children, and/or my horse

•I acknowledge that it is my responsibility to directly notify Hatha Equus if I do not want to show up in any photos or videos.

• I will reserve Hatha Equus the same treatment, and I will make sure that I only publicly share videos or photos I took at their clinics upon asking permission.
